 The following terms and conditions apply to the website, products and services offered by GOTiHe. This includes the mobile and tablet versions as well as any other version of GOTiHe accessible via desktop, mobile, tablet, social media or other devices.

The use of the website and the purchase of the products (hereinafter referred to as "Products") from such website, means that you agree to these terms and conditions as set out below (hereinafter referred to as "Terms").

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING, USING OR OBTAINING ANY MATERIALS, INFORMATION OR PRODUCTS.

1. Eligibility: The GOTiHe Giveaway sweepstakes is open to legal residents of the United States of America who sign up at https://www.gotihe.com/giveaway-entry-nov2022. Entrants must be [18 or older] as of their date of entry in this promotion in order to qualify. This sweepstakes is subject to federal, state, and local laws and regulations and void where prohibited by law. GOTIHE's employees, its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the GOTiHe Giveaway sweepstakes.

2. 3rd Party drawing. The drawing will be done using Simpliers’ Instagram giveaway tool (“3rd Party drawing”), located at https://simpliers.com/. 3rd Party drawing will conduct the Sweepstakes substantially as described in these Official Rules.

3. Agreement to Rules: By entering this sweepstakes, the Entrant (“You”) agrees to abide by GOTiHe's Official Rules and decisions, which are fully and unconditionally binding in all respects. GOTiHe reserve the right to refuse, withdraw, or disqualify any entry at any time at the GOTiHe’s sole discretion. By entering this [Sweepstakes] the You represents and warrants that You are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of GOTiHe as final and binding as it relates to the content of the GOTiHe Giveaway sweepstakes.

4.  Sweepstakes Entry Period: This promotion begins on November 1st, 2022, at 8:00 am ET and ends on Nov 24, 2022, at 11:59 am ET (“Entry Period”). To be eligible for the sweepstakes, entries must be received within the specified Entry Period.

5. How to Enter: Eligible entrants can enter the GOTiHe Giveaway Sweepstakes by submitting an entry via the online instructions provided at [https://gotihe.com/giveaway-entry-nov2022]. As a participant, your entry must fully meet all Sweepstakes requirements, as specified in the Official Rules, in order to be eligible to win a prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at GOTiHe's sole discretion. Entrants may only enter one entry. Current subscribers prior to the Sweepstakes may receive a complimentary or bonus entries to the sweepstakes at the GOTiHe’s sole discretion.

Fraudulent methods of entry or circumvention of the rules may result in GOTiHe invalidating your entries and removing them from the [Sweepstakes] at the GOTiHe’s sole discretion.

Eligible entrants must complete the 3 requirements listed below:

2. Fill out our quick questionnaire and Subscribe to our monthly newsletter via the subscribe button located on the https://www.GOTiHe.com/GiveAway-entry-Nov2022 site.

3. Tag 2 friends in the GOTiHe Black Friday Giveaway comments sections

**6. Prizes: The Winner(s) of the  GOTiHe Giveaway Sweepstakes (the “Winner”) will receive prizes listed below along with the retail values of each]. The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the GOTiHe. There shall be no cash or other prize substitution permitted except at the GOTiHe’s discretion. The prize is non-transferable. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, state, and federal taxes. The Winner(s) shall not transfer assignment of the prize to others, nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the GOTiHe to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.

One 1st place Prize shall be awarded. The 1st place prize consists of :

One 2nd place Prize shall be awarded. The 2nd place prize consists of :

One Testimonial Prize shall be awarded to each qualified entrant that also completes the testimonial entry. The Bonus prize consists of :

Multiple winners: 2 extra entries into the sweepstakes - Value: $0, it increases your odds of winning with 3 chances to win instead of 1.

Odds: The total number of eligible entries received determines the odds of winning.

7. Selection and Notification of Winner: The Winner will be selected by a random drawing under the supervision of the 3rd Party Drawing. The GOTiHe will notify the Winner(s) by email and/or Instagram Direct message provided in the subscription within five days following Winner selection. The GOTiHe is not responsible for nor shall have no liability for Winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall be GOTiHe be liable for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the prize within [14 days] from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the prize may be forfeited, and an alternate Winner may be selected. Receipt of the prize (offered in the [GOTiHe Giveaway] [Sweepstakes]) by the Winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE GOTiHe's SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by You: By submitting an entry (e.g., text, video, photo, etc.) into this [Sweepstakes], You understand and agree that the GOTiHe, any individual acting on GOTiHe’s behalf, and the licensees successors, and assigns of the GOTiHe shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, video, testimonials, likeness, image, statements about the [GOTiHe Giveaway] [Sweepstakes], and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.

Entries must be original work and not violate anyone’s proprietary or intellectual property rights. “You shall defend or settle against such claims at your sole expense, and You shall indemnify, defend and hold harmless GOTiHe from any suit, etc.

9. Terms & Conditions: In its sole discretion, GOTiHe reserves the right to modify, suspend, cancel, or terminate the [GOTiHe Giveaway] [Sweepstakes] should non-authorized human intervention, a bug or virus, fraud, or other causes beyond GOTiHe’s control, impact or corrupt the security, fairness, proper conduct, or administration of the [GOTiHe Giveaway] [Sweepstakes]. The GOTiHe, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the GOTiHe.   Individuals who tamper with or attempt to tamper with the operation or entry process of the [Sweepstakes] or website or violates these Terms & Conditions will be disqualified by the GOTiHe in its sole discretion. In its sole discretion, GOTiHe has the right to maintain the integrity of the [GOTiHe Giveaway] [Sweepstakes], to void votes for any reason, including, but not limited to: multiple entries from the same user; multiple entries from the same computer beyond the number allowed by the [GOTiHe Giveaway] rules; or the use of bots, macros, scripts, or other technical means for entering. Limitation of Liability: Your entry into this [Sweepstakes] constitutes Your agreement to release and hold harmless GOTiHe and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the  [Sweepstakes] and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.

11. Disputes: THIS [SWEEPSTAKES] IS GOVERNED BY THE LAWS OF  [UNITED STATES OF AMERICA] AND [NEW JERSEY], WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. The Entrant agrees, as a condition of participating in this promotion, that if any disputes cannot be resolved between the Entrant and the GOTiHe, and if causes of action arise out of or are connected with this [Sweepstakes], they shall be individually resolved exclusively before a court located in [New Jersey] having jurisdiction,  without resorting to any form of class action. Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this [Sweepstakes]). The participant waives all rights to have damages multiplied or increased.

Winners List: You may obtain a copy of the Winner’s name(s) or a copy of these Official Rules, by sending your request via mail with a stamped, self-addressed envelope to: GOTiHe Giveaway Apr, 96 Linwood Plaza, Suite 187, Fort Lee, NJ 07621 USA. Requests must be postmarked no later than [30-Dec-2022, 11:59pm, EST].

15. DISPUTES

16. FINAL PROVISIONS

These terms are governed by the USA laws. Use of our website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this paragraph.

Our performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of our website or information provided to or gathered by us with respect to such use.

If any part of these Terms is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision of these Terms at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.

Any rights not expressly granted herein are reserved.
